- Have you been injured in an accident due to negligent driving?
- Have you been injured in a road traffic collision due to negligent driving?
- Has the driver who collided with you had no insurance or cannot be identified?
Can you claim compensation for the injuries you have sustained?
In 1964 the Motor Insurers’ Bureau was formed. The Bureau is funded by all motor insurers in the United Kingdom. The Bureau compensates victims of road accidents caused by negligent uninsured drivers or hit and run motorists.
What can you claim for when hit by an uninsured driver?
- Damage to your vehicle and any losses arising from that damage, for example, hire car charges.
- Compensation for injury sustained and any losses arising from that injury, for example, loss of earnings. This may also include treatment and rehabilitation.
- Personal Property damaged within the vehicle due to the accident.
How long have I got to make a claim?
You should make the claim as soon as possible. You have 3 years from the date of the accident to make a claim for personal injury. If you have sustained damage to your vehicle or personal property and the driver was not insured then you must make the claim within 6 years, unless it occurred in Scotland where a 3 year period applies. If you have sustained both damage to your vehicle or personal property and personal injury then the claims should be made together and therefore within 3 years. If you sustained personal property damage in an accident and the driver cannot be traced you only have 9 months from the date of the incident to make a claim.
Should I report the incident to the Police?
Yes. You must report the accident to the Police immediately and co-operate with their investigations.
