A 24 year old beauty queen from Edinburgh suffered back injuries, chest and neck pain when she was involved in a road traffic accident back in April 2009.  The accident happened in Edinburgh when the car she was driving was hit by a Suzuki 4×4 after the driver swerved to avoid a parked car.  After exchanging contact details with the other driver she went home but later suffered with pain and bruising to her back and chest area. The next day she contacted her local doctor and after consultations with her GP was referred to a physiotherapist who diagnosed her with chronic back pain. 

After the accident the young lady went on to win the Miss Edinburgh title but her participation in charity and promotional events since the accident has been affected due to her back pain.  One reason for this was that during these events she was expected to wear high heels, but doing so aggravated the pain.  When assessing her claim for compensation the judge decided to consider this factor stating: ‘she was expected to wear high heel for promotional work.  Doing so aggravated her back’ and ‘her ability to participate in the usual range of events was limited because of her continuing back pain’.

Although the driver of the Suzuki admitted liability, the original offer of £3,500 compensation was not accepted and the young lady was awarded a total of £18,281 which included £10,000 for pain and suffering.
