Compensation

Compensation for Personal Injury is a payment of money to you and it is also called an Award of Damages.

There are two types of compensation:

General damages

The first type of compensation is known as “General Damages”. This is an amount of money paid to you to compensate you for the injury you have suffered  ie. to compensate you for the pain and suffering you have had to endure and the effect this has had on your working life, leisure activities and hobbies etc. The pain and suffering could be physical or psychological or both.

The second type if compensation  is known as “Special Damages”. This is an amount paid to you to compensate you for items of expense which you have had to pay out for or have lost due to your accident and injuries.  It can also cover the cost of items that you need to purchase in the future to assist you.

Special damages

Common examples of Special Damage include the following:

  •  Loss of earnings;
  •  Damage to clothing or belongings;
  •  Vehicle repairs, car hire and storage costs (in the case of a road traffic accident);
  •  Medical treatment such as physiotherapy, counselling etc
  •  Travel expenses such as bus, train, taxi fares and petrol expenses for attending medical appointments etc

Personal care or assistance that you need to help you cope with your injury.

It is always a good idea to keep receipts or tickets for anything that you pay out for as it will make is easier to claim back the money spent.

It is also important that you keep your payslips if you have suffered  loss of earnings although if you do not have them it is usually possible for the information to be obtained at a later stage from your employers.

Loss of earnings

This can often form a large part of your Special Damages claim.   It could arise if you  have to take time off work to recover from your injuries following an accident and you are either not paid by your employer for the time off sick by your employer or you are paid a reduced amount.

Any loss of earnings will also be  included in your claim for compensation.
