The term ‘personal injury’ has a broad definition and includes injuries which have occurred at work or in a public place, road traffic accidents, and health problems caused by the use of a faulty product or medical negligence.

How to calculate a Personal Injury Claim

Compensation, also known as damages, is the amount received by the injured party in a whiplash or other personal injury compensation claim. The aim of awarding damages in any whiplash or other personal injury compensation claim is to put the injured person in the position he or she was in prior to the accident. The amount awarded takes into account not only the injuries themselves, but also damage to property, cost of medical care and any loss of earnings. There are generally two categories of damages awarded for any personal injury compensation claim:

General Damages

This relates to any pain, suffering and loss of enjoyment of life caused by the injury. It is difficult to precisely calculate this type of damage in monetary terms, but compensation is the only remedy available for the injured party. A medical expert will conduct an examination and report which will form the evidence for an award of general damages. Compensation for loss of enjoyment includes any activity the injured party is no longer able to do, due to their injury, for example, playing football.

Special Damages

These relate to any financial losses incurred by the injured party and as such are easier for the courts and insurance companies to quantify. This category of damages includes:

    • Any damage to property relating to the accident. For example, vehicle damage as a result of a road traffic accident.
    • Loss of earnings. This includes both past and any future loss of earnings as a result of the accident.
    • Any other expenses paid or payable as a result of the accident. For example, if the injured party has had to pay for car hire or health care as a result of the accident.

As with general damages, evidence will need to be presented to support any claim for special damages so it is important to keep track of all payments made and if possible any receipts.

Limitation Period

For all whiplash compensation claims or other personal injury compensation claims, there is a time limit of 3 years from the date the injury occurred to bring a claim for compensation, so it is important to contact a personal injury solicitors as soon as possible after the accident.
