The government to inject some sanity into the whiplash debate
Last year claims fell by almost 24,000.
The Association of Personal Injury Lawyers (APIL) records showed 547,405 claims for whiplash in 2011/12, compared with 571,111 in 2010. This shows a fall of 4.2%. Figures also show that almost 40% of people with whiplash injuries have never claimed for compensation.
The APIL research appears as the government is expected to announce for new specialist medical panels to support improvements in the diagnosis of whiplash. The value is to increase from £1,000 to £5,000 to which claims can be handled by the small claims court.
It appears that the government has been persuaded by the insurance industry, that to raise car insurance premiums lies in tackling whiplash claims. As seen above, figures do show that claims have fallen in the last year.
The government is carefully considering any changes to whiplash as it is critical that they recognise that most injured people are genuine and that they have the right to expect proper access to justice when they need it.
A poll has been carried out amongst 4,000 members of the public. Results show that 1 in 100 people have suffered whiplash injury in the past year, 1 in 5 have suffered symptoms for more than a year, and 30% of those who suffered an injury were encouraged to claim compensation by insurance companies.
A member of the government submitted that insurers need to stop pointing the finger at everyone else and need to stop and look in the mirror, in that they need to stop paying compensation without even asking for a medical report. The government strongly believes that insurers should start sharing information that they hold about fraudsters and help solicitors identify them earlier in the process.
