We successfully pursued an industrial disease compensation claim for a client who was diagnosed with asbestosis due to coming into contact with asbestos during the course of his working life.
Our client worked for Ronald Trist Controls Limited, this is now known as Bestobell Mowbrey Limited, between 1955 and 1965. Then between 1967 and 1987 he was employed by Kraft Foods UK Limited which was previously called General Foods Limited.
Our client was a boiler control service and installation engineer. As part of his duties he was required to remove white asbestos lagging from boilers, he did this using a chisel. This was a very dusty job and our client was exposed to substantial amounts of asbestos throughout his employment. He was not provided with any protective breathing equipment and was not warned of the dangers of working with asbestos.
We were able to settled the claim on a provisional damages basis. This allows our client to return to claim further damages should his condition deteriorate or should he develop another asbestos condition in the future. Settling claims on a provisional basis allows clients to receive compensation, whilst giving them the peace of mind that, should their condition worsen, they can return to the insurers.
