If you have been injured in an accident during the last 3 years that you believe was caused by the fault of someone else, you may be entitled to claim compensation for the injuries you have suffered and any consequential financial losses you have incurred.

How to claim compensation

Please contact one of our specialist solicitors at What’s My Claim Worth they will discuss and advise you on the prospects of you succeeding should you wish to make a claim. Once you’re happy to continue with the personal injury claims process, we will set up a file for you and ask you to enter into a no win, no fee agreement with us. We will then arrange for a representative to meet with you to answer any questions you have before you enter into an agreement.

Once the no win, no fee agreement has been returned to us, we will begin the claims process for you and keep you informed of how the claim progresses and any developments along the way.

Depending on the potential value of your claim, your claim will either be submitted through what is known as the Claims Portal in which case a form known as a Claims Notification Form (CNF) will be prepared and sent to you for your approval before the claim is submitted. This CNF will set out in the circumstances of your accident, some brief information about the injuries you have suffered and why you consider your opponent was at fault.   Once the claim is submitted to the Claims Portal the defendants usually have either 30 or 40 working days to respond (depending on the type of accident you have had) with their decision as to whether or not they accept responsibility for your accident.

If your claim has a potential value of £25,000 or more then a formal Letter of Claim will be prepared and sent to you for your approval before it is sent to your opponent. The letter will detail the circumstances of your accident and why you consider it to be your opponent’s fault. Once your opponent receives the Letter of Claim, they are required to acknowledge receipt of the letter within 21 days and they then have a further 90 days to investigate the claim and respond to us with their decision as to whether or not they accept responsibility for your accident.
