Mrs M from Kidderminster, aged 75 years was injured when she fell down a step at a public house she was attending for lunch. The step was outside and was not clearly marked so as she stepped to the side she did not realise there was a drop down. Mrs M fell fracturing her elbow. The nature of her fracture meant she required surgery. We are very happy that Mrs M made a good recovery from her injuries. A claim was brought against the owners of the public house who initially failed to respond to correspondence.
Eventually under the threat of court proceedings they responded and admitted liability [responsibility] for the accident. To progress the claim medical evidence was obtained from a Consultant Orthopaedic Surgeon who confirmed her physical injuries. Mrs M also suffered from psychological injuries including a fear of using steps and stairs so we obtained a Medical Report from a Psychologist which confirmed this.
