What’s My Claim Worth specialist team settled a claim for a 27 year old man from Cumbria who injured his left thumb in an accident at work. Our client was working as a plumber was using a mitre saw to cut batons of wood. Whilst doing this his left hand slipped and came into contact with the blade of the saw and his left thumb was amputated. Fortunately, the thumb was saved and put into ice so that the Surgeon at Hospital was able to reattach the thumb which he did successfully. A claim was made against our client’s employer on the basis that the employer was negligent breaching their Statutory Duty. The Solicitor dealing with the claim alleged the employer failed to provide our client with adequate training or with adequate and safe equipment including Personal Protective Equipment. Our clients employer via their Employer’s Liability Insurance denied liability [responsibility] for the accident. They alleged our client was the author of his own misfortune.
The specialist solicitor dealing with the claim successfully argued this although at the same time did acknowledge there was a risk that a Judge may make a finding of contributory negligence, i.e. that the client was partly at fault for his own accident.
We were very happy when our client made a good recovery from his injuries. He was absent from work for 3 months and following his return to work as plumber he decided to have career change which meant he did not suffer any real future loss of earnings because of his injuries.
