What’s My Claim Worth settled a claim for Mr E, a 19 year old man from Wales who sustained a crush injury to his foot following an accident at work. Mr E was working in a factory operating a pump truck when another colleague reversed his reach truck into the forks of our client’s pump truck causing our client’s left foot to become crushed between the pump truck and the pallet. A claim was brought against his employer as they were vicariously liable for the negligent actions of the employee/worker who drove into our client’s pump truck. A claim was made via the Claims Portal to the Employers Insurers but they failed to respond within the time limits set by the Portal. After much chasing and the threat of commencing court proceedings, they eventually admitted liability [responsibility] for the accident. Our client attended hospital after his injury and was off work for 5 days so had incurred a small amount of lost earnings. In addition to claiming compensation for the injury and the period of pain and suffering, the solicitor also claimed for his loss of earnings and for the gratuitous care he was provided with by his family who helped him with bathing , household chores and preparing meals. A Medical Report was obtained from a Consultant Orthopaedic Surgeon who confirmed our client had an avulsion fracture on his left foot with symptoms lasting 4 to 6 weeks. Fortunately for our client he made a full recovery from his injuries. We were very pleased to agree settlement of Mr E’s claim in the sum of £3,276.30.
