What’s My Claim Worth successfully settled a claim for Mr M, a 33 year old from Birmingham who injured his right foot in an accident at work. Mr M was working as a labourer on a construction site at a hospital in the Midlands. At the time of the accident he was working with a colleague trying to move a large cage trolley. The wheels on the cage trolley were rusty making it difficult to move. Our client was pulling the trolley and his colleague was pushing the same and both had to use some force to get the trolley to move and in doing so cage trolley ran over our client’s foot.
A claim was brought against our client’s employer as they had failed to provide safe and adequate and properly maintained work equipment. They were also vicariously liable for the negligence of our client’s work colleague who pushed the trolley over our client’s foot. Mr M attended Birmingham City Hospital where it was firstly suspected he fractured his foot and his injury was dealt with accordingly. However, upon closer inspection of his x-rays it transpired there was actually no fracture and his injury was a soft tissue injury with symptoms lasting 12 weeks. We were very pleased to be able to reach settlement in the sum of just over £3,000 for Mr M.
