One of our solicitors successfully settled a claim for Mr C, a 53 year old man from Leeds who injured his arm in an accident whilst at work. He was working in a factory and had been asked, along with a colleague, to move a single lift from one building to another.
In order to be able to get the lift into the back of a van to move it they had to put the lift onto its side and then onto a pallet. There were handles either side of the lift and when our client and his colleague were trying to move the lift, the handle our client as holding flew off and the lift fell down crushing his left arm. He sustained soft tissue damage to his arm and muscle requiring hospital treatment.
Mr C contacted our team at What’s My Claim Worth and it was agreed his claim had good prospects of succeeding. The claim was dealt with on a “no win, no fee” basis and a claim for personal injury and financial loss was made against Mr C’s employers for negligence and breach of statutory duty having provided defective equipment to use.
The claim was investigated by the employers insurers and liability/responsibility for the accident was admitted. We promptly arranged for our client to be examined so that we could obtain a medical report from a Specialist Orthopaedic Surgeon. Upon receiving the Report, the Expert stated he was concerned that our client could be at risk of rupturing his bicep and recommended he had an MRI scan. The solicitor dealing with the claim arranged this on a private basis and the scan results were reviewed by the Orthopaedic Surgeon. Fortunately our client’s injuries turned out to not be as serious as they could have been.
Fortunately our client was able to continue working despite his injury and did not have any loss of earnings to be claimed. Our client was extremely happy when his claim settled for £5,000.
