Our client was a self-employed mobile service engineer contracted by the Defendant to attend their premises. At the entrance of the premises there was a barrier stopping vehicles passing through. There was a pedestrian walkway on one side and our client tripped and fell due to potholes in the pavement caused by loose concrete. As a result of the uneven surface our client fell forwards into the metal barrier resulting cutting his face and having tissue damage to his knees.
Being a lawful visitor to the premises, having been invited to carry out maintenance work, pursuant to the Occupiers Liability Act, the Defendant’s Insurer admitted responsibility, agreeing to pay compensation for our client’s injuries and financial losses. Our client was examined by an Orthopaedic Surgeon so that we could obtain a medical report confirming the injuries sustained and a prognosis on recovery. The Expert stated our client sustained facial lacerations together with an aggravation of pre-existing but asymptomatic degeneration to both knees which would have been present before the accident.
Our client was off work for 4 weeks due to the injuries and as he was self-employed he had a loss of earnings which we recovered for him, along with his damaged glasses.
