As Mrs L was leaving the office she was required to close the window but as the window was high up she had to kneel on her desk to reach and pull the window closed. As she did this she felt a pain in her right shoulder and was diagnosed with a soft tissue injury similar to frozen shoulder.
A claim was submitted to her employers on the basis they should have provided adequate equipment to close the window with. Liability was admitted by her employers who accepted they were to blame for her injury. We proceeded to obtain a medical report from a Consultant Orthopaedic Surgeon to confirm her injuries and provide a prognosis for the period of recovery. When the medical evidence was complete, settlement was negotiated in the sum of £3750.
