Our client was intending to cross the entrance to a busy supermarket. She saw the Defendant approaching but noticed there was a queue of traffic on the major road and went to cross in full view of the Defendant. As our client was virtually past the car park exit lane the Defendant pulled into the car park without looking and collided with our client. We submitted a claim to the Defendant’s Insurers and liability (fault) was denied throughout the claim.
We arranged for our client to be examined by an Orthopaedic Surgeon who provided a medical report confirming the closed fracture of the scaphoid distal pole would resolve within 3 months, and that the soft tissue injuries to her neck, buttocks and back would resolve within 16 months. The Expert agreed she would not be disadvantaged in the type of work she could do, now or in the future and there was no risk of deterioration.
Our client’s claim included a claim for assistance provided by her partner with household chores and self-care which was initially required following the accident. Our client was very happy with settlement in the sum of £9,000 for her injuries and financial losses.
