Fatal Road Traffic Collision

What’s My Claim Worth recently dealt with a claim on behalf of the Estate of a young man who died at the young age of 17 as a result of a road traffic collision. Sadly, the deceased was riding a moped on his way home from work when he was hit from behind by the Defendant driver who was later convicted of dangerous driving. He suffered a traumatic subarachnoid haemorrhage in the frontal region, a subdural hematoma, extensive fractures to his face and spinal injuries and unfortunately died within 2 days of the collision.  A claim was brought by his Estate for damages for pain and suffering, funeral costs and the cost of a proposed memorial bench at his former school.

Under the Fatal Accidents Act the parents were entitled to a Bereavement Award set at the derisory figure of £15,120. The deceased was unmarried and living with his parents at the time of his death and settlement was achieved for over £22,000. Assistance was also provided on a pro-bono basis to recover a pay out from the client’s insurance policy which included a death payment of £25,000.
