The incident occurred when a freestanding sign, placed outside the store, was blown over by a gust of wind, striking Mrs H on both legs as she exited the premises. 

Nature of the Incident and Injuries 

Mrs H sustained painful lacerations to both shins. Although she initially sought treatment from her GP, the risk of infection meant she required regular wound care and dressing changes administered by the practice nurse over several weeks. 

As a result of the accident, she also became temporarily reliant on her daughter for assistance with transport to medical appointments and household chores, tasks she was unable to manage while recovering from her injuries. 

Legal Action and Liability 

A public liability claim was brought against the supermarket, under the Occupiers’ Liability Act 1957, which requires occupiers of premises to take reasonable care to ensure lawful visitors are safe. In this case, it was alleged that the supermarket failed to assess the risk posed by leaving the sign outside in windy conditions, putting customers at risk. 

The supermarket responded to the claim and admitted liability, acknowledging that the sign should not have been in place during adverse weather conditions.
