He Stood on A Piece of Timber Which Rolled, Twisting Ankle
The case concerned a personal injury claim brought by our client against his employers. The incident occurred in March 2022, when our client was working as a labourer, was involved in the erection of formwork on a construction site. While adjusting a jack leg and attempting to gain extra height, he stood on a piece of timber which rolled, causing him to twist his left ankle and sustain injury.
What Were the Issues?
- Liability: There was an initial dispute regarding liability. The defendant at first denied liability pre-issue, but later admitted liability before medical evidence was completed, in the hope that settlement could be negotiated without the need to issue court proceedings.
- Causation and Medical Evidence: There were risks identified regarding causation, including the fact that the client did not seek immediate medical attention, and there were concerns about previous medical history or pre-existing injury potentially affecting the ability to prove the claim.
- Quantum (Value of the Claim): The extent of the injury and its impact on our client’s ability to work were central to the assessment of damages. The injury was described as a strain/sprain to the ankle, preventing work for more than 7 days.
- Other Risks: There were also risks related to limitation (the time elapsed since the accident), the possibility of previous claims affecting credibility, and the potential for a finding of fundamental dishonesty.
How Did the Case Settle?
- The case settled by way of a Part 36 offer made by the defendant, which the claimant accepted. The settlement amount was £6,500 in full and final settlement of the claim.
- The settlement was confirmed to the court, and the trial date was vacated as a result of the agreement.
