Our solicitors at What’s Mr Claim Worth have recently settled a claim for a gym user who suffered a dental injury as a result of faulty gym equipment.
What Happened
Mr H was carrying out a face pull exercise using a cable machine at the time of the incident. During the exercise, the cable suddenly snapped, causing the rope attachment to recoil and strike him in the mouth.
As a result of the impact, Mr H fell backwards and sustained an injury to his lower back.
Medical Treatment Required
Dental Injuries
The impact caused fracture injuries to Mr H’s two front teeth (upper right (UR1) and upper left (UL1) central incisor teeth).
One of the teeth was so badly damaged that it had to be removed and replaced with a dental implant and crown. The other tooth was repaired, although further treatment and replacement work may be needed in the future.
Following the accident, Mr H was left bleeding from the mouth, feeling dazed, and also suffered a concussion.
Back Injury
Mr H also injured his lower back when he fell causing pain to radiate to the left leg.
Mr H underwent physiotherapy and chiropractic treatment to help manage his ongoing symptoms. His lower back pain was particularly severe during the first two months following the accident, before gradually improving to a milder, intermittent level.
Challenges in the Claim
One of the key issues in the case was whether Mr H’s dental injuries and ongoing symptoms had been caused by the accident, particularly as he had previously received dental treatment before the incident.
There was also careful consideration around the cost of current and future dental treatment including a dental implant, loss of earnings, and ongoing care.
The Outcome
Following the exchange of medical evidence, the parties entered into negotiations and settlement was reached after a series of offers were made. The claim settled for £21,500.
