Despite the at-fault driver failing to stop and never being identified, we were able to pursue the claim through the Motor Insurers’ Bureau (MIB) and recover compensation on our client’s behalf.
The Accident
Our client was riding his motor scooter when a car suddenly cut across his path without warning. In an attempt to avoid a direct collision, our client was forced to swerve sharply, causing him to lose control of the scooter and be thrown from it onto the road.
The driver responsible failed to stop at the scene and was never traced.
The Injuries
As a result of the accident, our client suffered a fracture to his right collarbone, together with a head injury and concussion. During his recovery, he also began experiencing symptoms associated with thoracic outlet syndrome, a painful condition involving compression of nerves around the shoulder and neck area.
Given the complexity of the symptoms, extensive medical investigations were required, including nerve conduction studies, EMG testing, MRI scans, and a CT angiogram, to fully assess the extent of the injuries and long-term prognosis.
We obtained expert medical evidence from an Orthopaedic Surgeon, who confirmed that the clavicle fracture had healed satisfactorily. The medical evidence also carefully considered whether the ongoing symptoms were connected to the accident, ensuring the claim was properly evidenced throughout.
Building the Claim
