What Happened
Our client was working on site when a wall collapsed onto his leg. Following instructions from their boss, our client and his coworkers were pushing down a walls. During this process, the wall gave way and fell onto our client, trapping his leg underneath and causing injury.
Employer’s Liability
The case was brought on the basis that our client had been placed in an unsafe situation where there was a foreseeable risk of injury. It was alleged that his employer had failed to ensure staff were properly trained and supervised, had not provided a safe system of work, and had not carried out an adequate assessment of the risks involved.
The employer’s insurers later accepted that the accident had happened and acknowledged that failings on the employer’s part had contributed to the incident. However, while liability for the accident itself was admitted, there remained a dispute regarding the extent of the injuries and losses suffered by our client.
Injuries Sustained
Medical evidence confirmed that our client sustained a crush and soft tissue injury to his leg, shin and ankle and he would need physiotherapy.
Compensation Outcome
After negotiations with the employer’s insurers, we secured a total settlement of £9,881.68.
