Cheekbone Injury Claims

Why our clients love us.

cheekbone injury claims

The face can be susceptible to injury, with damage to the cheekbone being very painful for the injured person. You can receive a cheekbone injury in a number of ways, including workplace accidents, trips or slips and road traffic accidents.
A minor incident can unfortunately lead to a serious cheekbone injury and can impact other parts of your face.

The cheekbone is also scientifically referred to as the “zygomatic” or “malar bone” and any damage to the bone can be incredibly painful. Cheekbone injuries can result in the following:

  • Facial bruising

  • Breaks and fractures to the bone

  • Cheek deflation

  • Loss of sensation in the face

  • Facial swelling

A cheekbone injury, however big or small, can have a significant impact on your life. Often, those who have a facial injury can experience pain from muscle damage and broken bones. This can result in the victim requiring time off work and assistance with day to day activities.

Alongside physical pain, psychological damage can result from facial injuries as memories of a traumatic experience can be brought back due to looking at the injury in the mirror.

Common cheekbone injury claims

Within the UK, maintenance of roads and footpaths is the responsibility of the Highway Authority and Local Authorities. They are obliged to maintain all roads and public footpaths to a reasonable standard, to ensure the safety of motorists and the public.

If an accident is caused by unmaintained road or footpaths, those who receive cheekbone fractures as a consequence may be able to pursue a claim for compensation.

They would need to prove the Local Authorities were aware of the issues with the unmaintained roads and footpaths and failed to rectify the issues within a sufficient time frame.

The Health and Safety at Work Act 1974 imposes a legal liability on employers to ensure the well-being of visitors to their premises and their employees.

If a fractured cheekbone injury was due to an accident at work, and if your employer has been negligent in some way and has failed to comply with the 1974 Act, you may have a claim for compensation.

If the impact of a collision causes the driver or passengers to hit their face on the inside of the car, this may result in a cheekbone fracture.

You may have a claim for compensation against the driver who caused the accident or the driver of the car you were traveling in, if you are a passenger.

WHat compensation can i claim?

In a personal injury claim there are two categories of losses that we can claim compensation for:-

(1) Compensation for your pain, suffering and loss of amenity, known as ‘general damages’, to compensate for the direct effects of the accident. The amount depends on the type of injury and how severe the injury is.
(2) Compensation for out of pocket expenses, known as ‘special damages’, to compensate for financial losses including lost wages, care and assistance, medical costs and other expenses.
