Our client was working as an Escort for disabled children escorting them whilst they were on a bus.
She injured her back lifting a child, out of their seat and off the bus. Unfortunately, our client’s employer had not provided any training on the best practices for manual handling or how to lift.
Our client’s employer owed duties to her under the Manual Handling Regulations 1992 which required that where reasonably practicable manual handling should be eliminated and if that is not possible then a Risk Assessment must be carried out where there is a risk of injury due to the manual handling operation.
The employers initially tried to fight the claim but eventually were persuaded to concede they were responsible, although they continued to allege she was partly to blame.
What’s My Claim Worth arranged for her to undergo an independent medical assessment with a Consultant Orthopaedic Surgeon which revealed she had significant degenerative problems with her back, meaning that she already had problems with her back before the accident.
According to the Medical Expert, as a result of the accident her back symptoms were made worse by a period of 3 months. Any other symptoms after 3 months were not due to the accident itself but were due to problems she already suffered from before the accident. We were able to recover compensation of £1,500.
