We secured a £150,000 settlement for our retired client, who was injured as a pedestrian in a road traffic accident.
The Incident
Our client was crossing the road when they were struck by a car. The incident was captured on CCTV and, although the defendant’s insurer eventually accepted that their driver was mainly responsible for the accident, they argued that our client was partly at fault and would have continued to dispute this if the case had gone further.
Injuries and Recovery
The client sustained multiple serious injuries, including fractures to their ankle, leg, hip, and spine, as well as a head injury from which they fortunately made a relatively swift recovery.
Their rehabilitation involved a prolonged and challenging recovery period, including surgery, hospital treatment, and ongoing physiotherapy.
Assessing the Value of the Claim
An offer was received before independent medico-legal evidence had been finalised. As a result, careful consideration was given to the potential value of the claim.
This included general damages for pain, suffering, and loss of amenity, as well as financial losses such as past and future care needs, potential home adaptations, private treatment costs, travel expenses, and additional day-to-day living costs due to the accident.
Following a detailed assessment, the offer was considered reasonable on the assumption that the client’s recovery would continue as anticipated. The client was advised of the risks associated with settling at this stage – particularly given any unforeseen complications or future losses could not be claimed once the case concluded.
The Decision to Settle
With this in mind, the client chose to accept the settlement in order to achieve closure and avoid the uncertainty and delay of ongoing litigation.
Following settlement, the client expressed their appreciation for the support they received from friends and members of the local community during their recovery.
