We have successfully negotiated a settlement for a 58-year-old cyclist who was seriously injured in a road accident when a car knocked him off his bike.
The Incident
Mr. K, an enthusiastic cyclist, was riding along a peaceful country lane when a car, overtaking a jogger, swerved into his path. The driver, traveling in the opposite direction, veered onto Mr. K’s side of the road. To avoid a collision, Mr. K was forced to brake sharply, causing him to be thrown from his bike and land on the road.
Injuries and Consequences
As a result of the fall, Mr. K sustained several injuries including soft tissue damage to his elbow, a sprained finger, bruising, grazing, and soft tissue damage to his right hip. He required hospital treatment after the accident, and his injuries made it difficult for him to lift objects and disrupted his sleep.
Taking Action
We filed the claim and the driver’s insurers accepted liability for the accident. To support the claim, we obtained a report from an independent medical expert who confirmed the extent of Mr. K’s injuries.
In addition to his personal injuries, Mr. K’s bicycle was also severely damaged and, unfortunately, was unsafe to use and could not be repaired. As the manufacturer of his bike had gone into liquidation, Mr K was unable to purchase the same bike and so we obtained quotes for similar bikes, and secured compensation for the cost of a replacement, as well as his damaged clothing and helmet.
A Favourable Settlement
