Maria Pilkington, a solicitor who heads up our Personal Injury Department has secured a settlement for our client, Ms B aged 45 years from Cornwall who was injured during an accident at work. Our client was working in Sainsbury’s supermarket and was stood on a footstool whilst putting stock onto the shelves. As she was trying to get down from the footstool it moved causing her to fall and land on her back.
A claim was brought against her employers on the basis that the foot stool was defective as it should not have moved and on closing examination of the footstool after the accident it appeared that the wheels on his which were supposed to lock were defective.
Medical evidence was obtained from a Consultant Orthopaedic surgeon who following an MRI scan confirmed that our client has sustained an injury to her back and coccyx.
The insurers for her employers denied liability/responsibility for the accident and were trying to argue that it was our client’s fault and that she simply missed her footing.
As a result of the Defendant’s stance we had to commence court proceedings to progress the claim.
The case was listed for a trial but shortly before the trial we were pleased to be able to negotiate a settlement for our client in the sum of £5400.
