What’s My Claim Worth have just settled a claim for Mr T, a 37 year old man from Manchester who tripped and fell whilst at work. Mr T was a HGV driver subcontracted by his employer to work in a warehouse belonging to Boohoo.com moving trailers full of clothing and goods from one warehouse to another. Mr T reversed his articulated lorry to connect with a trailer. He then proceeded to walk down the side of the trailer to close the trailer doors at the back so that he could drive off. Upon doing this, on the floor to the left hand side of where he was walking were a number of abandoned metal pipes. As Mr T was closing the trailer doors he had no alternative but to step on these pipes as there was nowhere else for him to stand. As he did so the pipes moved and he went over on his right ankle sustaining a sprain/soft tissue injury. The accident occurred at a time when due to covid people were encouraged not to seek medical treatment unless it was an emergency so Mr T treated himself at home with pain killers, bandages and rest. He was off work for approximately 3 days. In support of the claim for Mr T our solicitor obtained medical evidence from an independent Consultant Orthopaedic Surgeon who confirmed his injuries and gave a period for recovery. A claim was submitted against Boohoo.com who denied liability [responsibility] for the accident so given their stance court proceedings were the commenced. Following the start of court proceedings, the solicitor dealing with the claim was able to reach a settlement in the sum of £4,000. Mr T was delighted with the result as all he had been hoping to recover was the loss of earnings claim as he was unable to work.
