Agency Worker Awarded £5000 After Accident Involving Machine

What’s My Claim worth settled a claim for an agency worker injured at work. Mr K was awarded £5000 after he fractured his dominant ring finger operating a machine which cuts plastic board parts. 

The machine broke due to plastic parts melting on the drill bit, and our client was told by the Defendant to just break off the melted plastic with a hammer and screwdriver. In doing so, our client’s hand slipped, and he was injured. Liability (fault) was disputed by the Defendant’s Insurers saying our client had failed to report the accident, and that he had been trained in the reporting procedure.  They said our client would not have been told how to clean the machine, and he was not trained how to set it up or change tools on it. 

Fortunately the accident was captured on CCTV which we obtained. A telephone Conference took place with a Barrister to determine the prospects of Mr K’s claim. The Barrister was of the opinion our client would succeed in his claim and the Defendant’s Insurers were referred to the CCTV footage, following which they agreed to deal with the claim.

The claim proceeded towards settlement after our client was medically examined to obtain a medical report on his injuries. Our client was off work for 2 months due to the injuries and he received physiotherapy treatment.  Our client’s fracture healed satisfactorily within 18 months from the accident date and he was very happy to receive £5000 for his injury and financial losses.
