One of our Solicitors had success in a claim when a client fractured her dominant elbow in an accident at work after slipping on ice whilst leaving work. Her employer failed to ensure the area was safe by gritting and was therefore negligent. Our client was working as a cleaner so was in the workplace early. She had finished her shift and was leaving the building about 9.30 am via the front entrance as she normally did. As she walked outside the building she suddenly slipped on the icy ground which had not been gritted.
At that time outside was being gritted by a colleague but the gritting had started at the other end of the building rather than at the entrance. A claim was presented to the employer on the grounds that they failed to grit, knowing full well she would be leaving work, exposed her to a foreseeable risk of injury, failed to make the area safe for her to walk upon, failed to ensure her workplace floors were safe to walk upon, failed to prevent her from walking on the said icy floor and failed to ensure she was safe at work.
Liability was denied by the employers insurers however the solicitor dealing with the claim was confident the claim had good prospects of winning at Trial so arranged for the client to be examined by an Orthopaedic Surgeon who specialised in elbow injuries. Medical evidence was obtained and financial losses were ascertained. The solicitor dealing with the case continued to argue the claim however they maintained their denial, so due to limitation, the claim was issued at court. Eventually the solicitors on the otherside agreed to settle the claim after 2 years of denying their client was responsible. They made a Part 36 offer to settle the claim of £3,200 which the Claimant decided to accept, despite the fact that this may have been less than her claim was worth.
