Our client worked as a painter & decorator and on the day of the accident was correctly driving on a main road when the Defendant reversed out of a side road at speed, into our client’s path. In order to prove our client’s injuries we had to obtain a Medical Report from an Orthopaedic Surgeon. The Expert confirmed the fractured clavicle should fully recover within 3 months. In the meantime, our client had to change jobs, partially due to the injury and therefore suffered loss of earnings for a brief period. Liability (fault) was admitted by the Insurers for the Defendant soon after the claim was submitted and we were able to secure an early interim payment for the client to help with any financial difficulties.
To conclude the claim quickly we submitted an offer to the Defendants Insurers which was rejected. Despite the solicitor making further reasonable offers, settlement could not be agreed and the claim had to be issued at court to be assessed by a Judge.
We were very happy when the claim settled for more than the Defendant’s offer.
