The Defendant failed to see the client who was correctly proceeding along the road and unfortunately collided with him. The client, who had, prior to the accident, enjoyed playing golf, cycling and walking alongside riding his motorcycle suffered a very nasty fracture and dislocation of his ankle enduring two surgical procedures to put his ankle back into the correct position together with surgery to fix the ankle break to the fibula. He was in hospital for 3 days and 2 nights due to the severity of his injuries. The client will be left with an increased risk of developing osteoarthritis in his later years and psychological injury in the form of adjustment disorder and fear of travel, the symptoms of which would reduce with treatment within 3 years of the date of the collision. Liability was admitted by the Defendant within a short space of time and court proceedings did not need to be issued. Our client had just started a new business and had limited evidence to prove potential future loss of earnings, particularly as this business was started immediately before the Covid pandemic.
