Our client and his two witnesses had advised us that the driver had parked his van just after a sharp bend on a country road.
The defendant served witness evidence and said that our client had slipped on leaves due to cycling too fast.
We issued court proceedings and we were able to satisfy that the defendant and witnesses’ evidence was weak.
We used the GP’s printouts which did show that our client was not cycling too fast, and the witness evidence from two of our client’s friends illustrated that our client was an extremely competent cyclist and that his version of events was far more plausible than the defendant’s.
Our client was successful and recovered £1,800 by way of compensation.
