Defective Glass Table Causes Injury To Young Girl

What’s My Claim Worth team secured settlement for Miss L, a 16 year old girl from North Wales who sustained a laceration to her thigh when she fell onto a glass table which shattered on impact. Our specialist lawyer brought a claim against the shop which sold the table as the glass should not have broken and the table should have been fitted with toughened glass. Miss L attended hospital following the accident where she required stitches and was left with a 9cm scar. Medical evidence was obtained from a Consultant Plastic Surgeon who recommended Miss L had scar revision surgery to improve the appearance of the scar. However given her young age this would have to be done under a general anaesthetic and Miss L was worried about having a general anaesthetic so did not want to have the surgery until she was an adult when it could be performed under a local anaesthetic.  

The lawyer acting for Miss L claimed for the cost of the future surgery and also the cost of camouflage makeup to help improve the appearance of the scar. As Miss L was only 16, she was deemed a child and had to be represented by an adult, in this case her father acted as what is known as a “Litigation Friend”.

Settlement was reached in the sum of £30,000 which was a fantastic result especially considering the Barrister who prepared a written Advice on the value of the claim was of the view that a Judge may award no more than £18,000. As Miss L was a child the settlement had to be approved by a Judge at a Court Hearing. When approved the compensation amount of £30,000 would then paid into the Court Funds Office where it would be invested until Miss L reached 18 years of age. She could then apply to the Court for the money to be paid to her.
