Our client, a man in his 80’s sustained a proximal femur fracture requiring surgery after being hit by the Defendant whilst crossing the road. He spent approximately 5 weeks hospitalised before returning home whereafter he was cared for by his son who moved in permanently. As a result of the accident our client suffered from low mood due to his incapacity.

Proving causation (i.e. the injuries were caused by the accident) was complicated by our client’s previous medical history. In an attempt to settle the claim without issuing court proceedings several offers were made. Settlement was not reached so proceedings were issued. A counter offer was received which was rejected so negotiations continued until a final offer was received from the Defendants Solicitors which our client accepted as he was reluctant to proceed to a Court Hearing due to being anxious to conclude the claim. Settlement was reached in the sum of £115,000.
