Our client, a 56-year-old man from Manchester, was working on a construction site attempting to lift a road plate so that straps could be positioned underneath.
A colleague used a shovel to raise one edge of the plate; however, the shovel either slipped or was released, causing the heavy metal plate to fall and trap our client’s right thumb and middle finger.
Who was Responsible
A claim was pursued against the employer on the basis that they had failed to implement a safe system of work and were vicariously liable (legally responsible for the actions or negligence of their employee) for the negligence of the employee involved.
Following negotiations, the employer’s insurers admitted liability.
Expert Medical Evidence
To support the claim, we obtained expert medical evidence from a Consultant Plastic and Hand Surgeon. They expert confirmed that our client sustained injuries to the nail of his right thumb and the tip of his finger. He was also experiencing symptoms of pain in cold weather and reduced grip strength.
Impact on Employment
On behalf of our client we pursued a claim for compensation for the injuries he sustained and the impact his injuries may have on his future employment prospects. Thankfully, he did not suffer any loss of earnings or incur any financial expenses as a result of the accident. However, his injuries did leave him at a slight disadvantage when competing for work in the future job market.
The Outcome
Following negotiations with the Defendant’s insurers our specialist solicitors at What’s My Claim Worth successfully secured a settlement for the client of £16,700.
