Fall Through A Balcony Leads To Multiple Injuries And Settlement Of £25,000

Our specialist team recently secured a settlement of £25,000 in compensation for a 35 year old male from Cheshire who sustained multiple injuries when he fell through the balcony of his friend’s first floor apartment. The balcony was wooden and due to the wood being rotten as the client was walking on the balcony the floor collapsed. He fell to the ground impaling himself on a bush. As a result of the fall he sustained soft tissue injuries to his back, neck, shoulder and knee, grazing to his face and an injury to his bottom. A claim was made against the Management Company for the property, who would not accept liability (responsibility) for the accident as they claimed they had never been made aware of a problem with the balcony before the accident.  Whilst this was true, due to the persistence of the team here at What’s My Claim Worth we were able to gather sufficient evidence to show that the company knew or ought to have known that the balcony was potentially dangerous. Eventually the Defendant’s Insurers for the Management Company accepted liability. The solicitor dealing with the claim arranged for their client to be examined by both an Orthopaedic Surgeon and Plastic Surgeon and the claim progressed to settlement without the need to issue court proceedings.
