Our client suffered damage to one of her front teeth which required splinting and dental work, together with soft tissue injuries to her face, bruising to the right side of her body, and she developed a fear of cars. Mrs B instructed our personal injury team and Allison Pepper dealt with the claim for her. The claim was presented to the Insurers and liability (fault) was admitted.
At the time of the accident our client was wearing a fluorescent green top whilst waiting at a junction for another car to turn right, when she began to cross. As our client was halfway across the road, she was struck by the Defendant from her right side, causing her to bang her face on the Defendant’s vehicle before landing on the ground.
Our client’s front tooth had to be repositioned from its protruded position. A splint was placed on it and our client proceeded to have root canal treatment. In order to progress the claim we needed to obtain medical evidence and instructed a Dentist to examine our client and prepare a Dental Report. Dental evidence confirmed the long term prognosis for the tooth was good, and that it was likely to remain in situ for at least the following 10 years, although there remained a 30% chance of resorption affecting the root tooth within the next 10 years and evidence suggested only 20% of root treated teeth survive after 20 years in dental practice.
On this basis it was likely root canal treatment would need replacing once during our client’s lifetime. We included the cost of this within the claim. Our team successfully concluded the claim within 12 months of the accident, without the need for issuing court proceedings and our client was awarded over £12,000 for her physical injuries and financial losses.
