Fall in the Toilets during a Ice Hockey Match
The accident occurred in April 2024. Our client, Mrs D was a lawful visitor to the ice rink, watching an ice hockey match with her husband and grandchildren. She entered the ladies’ toilets when, suddenly and without warning, she tripped and fell. The floor in the toilets was made of rubber matting, which was torn and raised, creating a tripping hazard. She was unable to get up and was taken by ambulance to hospital.
Local County Council held Responsible
The defendant, the local County Council, was held responsible in negligence and/or under the Occupiers’ Liability Act 1957 s2(1) for failing to take reasonable care to ensure the safety of lawful visitors. Specific allegations included:
- Failing to devise, institute, or operate an adequate system for identifying or dealing with defects in the floor;
- Causing or permitting the rubber matting to become defective and to remain on the floor;
- Exposing the claimant to a danger or tripping hazard and a foreseeable risk of injury;
- Failing to prevent the claimant from walking in the vicinity of the defective matting;
- Failing to discharge the common law duty of care to ensure the claimant was safe in using the premises.
Primary liability for the accident was admitted by the defendant’s insurers.
Left Hip Fracture, Unable to Bear Weight
Mrs D suffered a left hip fracture as a result of the fall. She experienced immediate pain and an inability to weight bear. An x-ray confirmed the fracture, and she subsequently underwent a total hip replacement. She required painkillers and received physiotherapy as part of her recovery which our specialist team were able to arrange on a private basis to assist in her rehabilitation.
