Success after tripping accident at work!

We recently settled a case for a 46 year woman, Ms N from London who worked as a Teaching Assistant.

A claim was made against the construction company who denied liability.   Whilst the solicitor acting for Ms N accepted there may be some element of contributory negligence (i.e. that Ms N was partly at fault) it was still considered the claim had reasonable prospects of succeeding. She fractured her elbow when she fell whilst walking through the school playground and tripping over a hosepipe which was on the ground.

This was being used by construction workers who were building a new sports pitch on the school premises.  Our client was seen on CCTV footage as having already walked/stepped over the hosepipe on several occasions prior to her accident and so presumably she was aware of the presence of the hosepipe.  

Just before court proceedings were commenced the solicitor was able to reach settlement with the Defendant’s Insurers of £18,500.   This was an extremely good result given the fact that Ms N did not suffer any loss of earnings as she was paid in full by her employers whilst off work.
