Our client was a doctor who was injured whilst driving her vehicle and was hit from behind. Her dogs were in the car and she was scared they had also been injured. Our client sustained an ankle injury and aggravated pre-existing wrist and shoulder pain. She also injured her index finger.
Our team submitted the claim to the Defendant’s Insurers and they raised causation from an early stage arguing that our client could not have been injured as a result of the accident. The solicitor dealing with the claim had no option but to issue court proceedings. One point raised by the Defendants Insurers was that it had been a significant period of time since the accident occurred before our client made the claim. We reminded the Defendants Insurers that our client had 3 years from the accident to make the claim. The claim successfully settled for our client.
