Successful Workplace Injury Claim: £10,300 Settlement For Retail Assistant Following Trip Incident

Trip Over a Shopping Bag 

Ms J was employed as a shop assistant and was working behind the tills when she tripped over a shopping bag that had been left on the floor. These bags, provided by the store itself, had not been stored safely and created a clear tripping hazard in the walkway. 

Injuries Sustained 

As a result of the fall, Ms J injured both her wrist and knee. While her wrist was initially suspected to be fractured, subsequent hospital investigations confirmed a soft tissue injury. Nevertheless, the pain and reduced mobility from these injuries led to a three-month absence from work

Due to her employer not paying her in full during her time off, Ms J experienced a loss of earnings – a key component which we included in her claim for damages. 

Legal Approach and Employer Liability 

A claim was brought against her employer for negligence and breach of statutory duty. Employers have a legal obligation to ensure that staff have a safe working environment, and in this case, there was a clear failure to maintain safe walkways, free from obstructions. 

The department store’s insurers accepted full liability for the incident.
